There are two main ways to sell real estate. The most common way is for a buyer to get a loan from a bank. The cash for the purchase goes to the seller and the buyer pays the bank in monthly payments. A less common but very flexible way of selling is called Owner Financing. Using this method, the buyer typically provides a down payment to the seller and then makes payments to the seller. In other words, the seller becomes the bank and receives the benefits that would otherwise go to the bank. The main advantages of Owner Financing, also known as Seller Financing, are:

  • Owner financed properties almost always sell for a higher price.

  • Owner financed properties almost always sell faster. Much faster. Even in slow markets or with non-conforming properties.

  • There are many more quality buyers available when seller financing is available. This is because banks are strict and consider many people high risk who, in reality, are very credit worth. People in this category include self employed people, retired people, buyers on fixed incomes and many other categories.

  • There are many types of properties which are hard or impossible to finance using conventional financing. Properties that fit into this category are manufactured homes on land, vacant land, commercial property, multi-family property and many others. Offering owner financing can make selling these non-conforming properties much easier.

  • There are no fixed terms of repayment, making it much easier to meet the needs of both the buyer and the seller

  • The interest is paid TO THE SELLER which can double or triple the total amount of cash the seller receives over the life of the contract. (Which is exactly why banks make loans)

  • If you are receiving monthly payments from property you sold in New Mexico, you can probably sell the payments for cash. Sellers do not have to wait until the contract pays off.

Owner financing is "made legal" by a title company that builds a document called a "Real Estate Contract". There are other documents that might be used instead ... a note and mortgage or an note and deed of trust. Regardless of the document type, if you are receiving payments from property you sold, you can probably sell the contract or note for a lump sum of cash.
